各有關(guān)單位:

隨著我國經(jīng)濟(jì)不斷發(fā)展,建筑行業(yè)的市場競爭也不斷加劇,而建設(shè)施工企業(yè)經(jīng)營過程中,各環(huán)節(jié)所涉及的法律風(fēng)險問題也日益增多。“索賠”這個詞已越來越為人們所熟悉,并日益成為企業(yè)關(guān)注的一個焦點問題。索賠工作的正常開展,有利于落實合同雙方權(quán)益,同時也是雙方用科學(xué)的方法和法律手段爭取自己利益的途徑。因此了解和掌握索賠工作的內(nèi)容應(yīng)注意的問題,及如何科學(xué)運用有效的方法開展索賠事宜顯得尤為重要,應(yīng)有關(guān)單位要求,中國建筑培訓(xùn)網(wǎng)決定召開 “現(xiàn)代建設(shè)項目爭端、仲裁、索賠、訴訟法律風(fēng)險防范實務(wù)研討會”。

本次會議將邀請國內(nèi)權(quán)威法律工作者及最高人民法院相關(guān)領(lǐng)導(dǎo)參與交流研討,請各相關(guān)單位領(lǐng)導(dǎo)選派代表參與詳細(xì)內(nèi)容如下:

一、會議內(nèi)容:

1、建設(shè)工程項目風(fēng)險防范典型案例與實務(wù)

重點關(guān)注:建筑企業(yè)如何有效防范金融危機(jī)帶來的影響

1) 招標(biāo)投標(biāo)中存在的法律風(fēng)險、易引起爭議和糾紛點及規(guī)避與防范的措施;

2) 建設(shè)工程合同的法律風(fēng)險規(guī)避與合同糾紛處理技巧;

3) 企業(yè)內(nèi)部承包,分包、掛靠、轉(zhuǎn)包存在的法律風(fēng)險及規(guī)避和應(yīng)對措施;

4) 建設(shè)工程質(zhì)量控制中的法律風(fēng)險與防范;

5) 建設(shè)項目進(jìn)度控制及工程竣工驗收階段的法律風(fēng)險與防范;

6) 應(yīng)用保險和擔(dān)保控制建設(shè)工程項目風(fēng)險;

7) 使項目管理者始終處于法律有利地位證據(jù)的收集,制造、保管和固定技巧;

8) 司法解釋對解決拖欠工程款的新規(guī)定以及對合同管理提出的新要求。

重點關(guān)注:已簽訂的建設(shè)工程施工合同中對索賠的約定

1) 建設(shè)工程施工合同示范文本的索賠規(guī)定及合同版本解讀;

2) 在工程項目施工全過程中預(yù)測、尋找和發(fā)現(xiàn)索賠機(jī)會;

3) 不可抗力的界定與非人為造成質(zhì)量變化引發(fā)的索賠;

4) 建設(shè)工程合同糾紛中對工程價款的確定;

5) 建設(shè)工程索賠常見的幾種解決方式;

6) 施工索賠的法律理論和法律依據(jù), 建設(shè)工程索賠案例;

7) FIDIC合同條件與《建設(shè)工程施工合同(示范文本)》差異

8) 施工單位加強合約管理的主要環(huán)節(jié);
